Environmental Law and Mass Torts

What Are Environmental Mass Torts?

Environmental Mass Torts stem from a situation in which a large number of individuals or businesses suffer harm or damages that arise from the negligence or misconduct of a common source Defendant. 


Although the injuries arise from a common nucleus that caused the toxic exposure, pollution, or contamination, the  injuries suffered by each of the various plaintiffs' in the community may differ in scope and extent. 


Examples of catastrophic Mass Torts include:


  • Wildfires
  • Gas Leaks
  • Groundwater Contamination
  • Pollution and Air Quality from Methane Leaks
  • Toxic Exposure
  • Waste Disposal
  • Defective Products 
  • Pharmaceutical Drugs 


In an enviromental mass tort each plaintiff brings forward their own case, unlike a class action.  This approach allows for a more tailored focus on the each individual plaintiff's damages in order to seek rightful compensation.
