Strength in Numbers When Corporations Cause Widespread Harm

Some corporate misconduct affects not just one person but thousands or millions. When a company sells a defective product, engages in deceptive marketing, violates consumer privacy, overcharges customers, or commits widespread employment violations, the harm may be too small for any one individual to justify a standalone lawsuit—but the aggregate impact is enormous. Class action lawsuits exist to address exactly this problem, allowing large groups of people who were harmed in the same way to pursue justice together.

How Class Actions Work

A class action is a lawsuit filed by one or a few named plaintiffs on behalf of a larger group—the class—who all experienced similar harm from the same defendant’s conduct. The court must certify the class by finding that the number of affected individuals is large enough to make individual lawsuits impractical, that common questions of law and fact exist among all class members, that the named plaintiffs’ claims are typical of the class, and that the named plaintiffs and their attorneys will adequately represent the class’s interests.

Once certified, the case proceeds on behalf of the entire class. If the case results in a settlement or verdict, all class members share in the recovery.

Common Types of Class Actions

Class actions in Los Angeles frequently involve consumer fraud and deceptive business practices, defective products affecting large numbers of consumers, data breaches and privacy violations, wage and hour violations across an employer’s workforce, securities fraud and investor class actions, environmental contamination affecting communities, and unfair insurance practices. California’s Consumer Legal Remedies Act, Unfair Competition Law, and False Advertising Law provide powerful legal frameworks for consumer class actions.

Compensation and Outcomes

Class action recoveries vary widely depending on the size of the class and the nature of the harm. Outcomes may include monetary settlements distributed to all class members, injunctive relief requiring the defendant to change its practices, refunds or credits, coupons or vouchers, and cy pres awards to charitable organizations when individual distributions are impractical. Major class actions can result in settlements in the hundreds of millions or even billions of dollars.
