Device Breakage During Removal Causing Serious Injuries

Home › Mass Torts › Paragard IUD Injury Claims

The Paragard IUD is a copper-based intrauterine device used by hundreds of thousands of women as a long-term, hormone-free form of contraception. It was marketed as safe, effective, and easily removable. But a disturbing number of women have discovered that Paragard is anything but easy to remove. Reports of the device breaking apart during removal have led to thousands of injury claims against the manufacturers, Teva Pharmaceuticals and CooperSurgical.

How the Device Fails

The Paragard IUD is designed to be removed in a simple office procedure. But in far too many cases, the device fractures during removal—its copper arms snapping off inside the uterus. When this happens, the broken pieces can embed in uterine tissue, perforate the uterine wall, migrate to other organs, and cause infections, scarring, and chronic pain.

For many women, what should have been a routine procedure turns into an emergency. Surgical intervention—sometimes including hysterectomy—may be necessary to retrieve the broken fragments. Some women are left permanently unable to have children. Others endure multiple surgeries and ongoing pain that affects every aspect of their daily lives.

Who Is Affected

Women who had a Paragard IUD and experienced device breakage or fracture during removal are the primary claimants. This includes women who required surgery to remove broken fragments, those who suffered uterine perforation, organ damage, or infection, women who became infertile as a result of the device failure, and anyone who experienced chronic pain or other lasting complications from a failed removal. As of early 2026, nearly 4,000 claims are pending in the federal Paragard MDL, with the first bellwether trials underway.

Compensation Available

Paragard injury claims may seek compensation for emergency and surgical medical costs, infertility treatment or loss of reproductive capacity, chronic pain management, emotional distress and diminished quality of life, lost wages during recovery, and future medical needs. Estimated settlement values range from $10,000 to $30,000 for mild cases involving fragment removal without major complications, to $100,000 to $380,000 or more for severe cases involving hysterectomy, infertility, or major surgery.

Frequently Asked Questions

These claims are specific to women who experienced device breakage, fracture, or complications during removal. If your removal was routine and without complication, a claim would not typically apply.
If your device is functioning normally and you are not experiencing symptoms, there is no emergency. However, when the time comes for removal, make sure your provider is aware of the breakage risk and is prepared to manage potential complications.
